The Law Society alleged that Vaibhav Phukela, 2014, of Halton,
committed professional misconduct.
The panel determined that the following allegations were established:
of Conduct, and section 49.3(2) of the Law Society Act, the respondent
has failed to cooperate with an investigation of the Law Society, by
failing to provide a prompt and complete response to requests made in
writing by the Law Society for information and documents.
The panel orders:
1. The respondent’s licence to provide legal services shall be suspended for
one month, commencing at the end of any administrative suspension,
Director, Professional Regulation, or her designate, the respondent has
provided a complete response to the requests made by the Law Society
investigation counsel in an email dated January 29, 2018.
2. While his licence is suspended, the respondent shall fully comply with
the terms of the Law Society’s Guidelines for Paralegals Who Are
Suspended or Who Have Given an Undertaking Not to Provide Legal
3. The respondent shall pay a fine in the amount of $2,000 to the Law
Society on or before July 15, 2018. Starting the day following the
deadline to pay this fine, interest will accrue at a rate of 3% per year.
Director, Professional Regulation, or her designate, the condition listed
at paragraph 1, above, by august 15, 2018, he shall pay a further fine
to the Law Society in the amount of $2,000 on or before September
15, 2018. Starting the day following the deadline to pay this fine,
interest will accrue at a rate of 3% per year.
5. The respondent shall pay costs to the Law Society in the amount of
$1,545.00 on or before December 15, 2018. Commencing immediately
after that date, interest shall accrue on any unpaid part of these costs at
a rate of 3% per year.
