I’ll drag you out of here”, or words to that effect. N.M. grabbed
Jane and dragged her from the room and down a flight of stairs,
tearing her shirt. He left her at the bottom of the stairs on the
floor, where she vomited.
Jane overheard N.M. speaking on the phone with a woman
who was waiting outside in N.M.s’ car. N.M. approached Jane
with a knife, pointing it at her and telling her to leave. She
begged him to stop and told him that he was hurting their child.
N.M. pinned Jane against the wall and choked her. She then told
N.M. that she would leave but needed a few minutes to get ready.
In response, N.M. said that he would tie her up in the basement.
He dragged Jane down another flight of stairs and found
some rope. Jane fought back and N.M. went upstairs. When he
returned, he said he had called her a cab and told her, “you get
out of here”. N.M. gave the driver money for the cab ride and
pushed Jane out of the door. Jane saw the other woman in N.M.s’
car and went over to confront her. N.M. then grabbed Jane from
behind and threw her against the back of the cab. Jane left.
Continued abuse between September 2013 and March 2014
Jane avoided N.M. for about a month after the September
2013 incident because she was afraid of him. Despite this, believing that their child should have a father, she reconciled with
him in late October 2013. Jane gave birth to their son M.K. in
In January 2014, N.M. began to abuse Jane almost daily.
He would frequently choke her, throw her around the house, drag
her up or down stairs and cover her mouth with such force that
it left bruises.
N.M. also verbally abused Jane. He made derogatory remarks about her. He would often tell Jane to go kill herself. He
was easily provoked and would become enraged by trivial things.
The M.s frequently witnessed N.M.s’ abusive behaviour
because it took place at their house. On numerous occasions,
N.M.s’ father saw him choking Jane or dragging her down stairs.
The M.s also saw the bruises caused by N.M.s’ physical abuse.
N.M.s’ mother asked how she had got her bruises and Jane told
her that N.M. had given them to her. Despite this, the M.s did
nothing to intervene in Ns’ abuse of Jane, except to occasionally
tell him to “get off that girl”.
Events in March 2014
On an unspecified date in March 2014, Jane and M.K.
were spending the night at the M.s’ house. N.M. arrived home at
approximately 4:00 a.m. His return woke Jane, who asked him to
